1. General

These Terms and Conditions govern all purchases made at MALWA GROUP (the “Company”) in-store and through delivery. By placing an order, the customer (“Customer”) agrees to these Terms and Conditions.

2. Responsibility for Purchases

Customers are fully responsible for all orders purchased at MALWA GROUP.

Once the purchase has been completed and the Customer has left the shop premises, no refunds will be provided.

3. Delivery Orders

For delivery orders, the Customer must ensure availability at the delivery address during the agreed delivery time.

If the Customer is not at home, the carrier is authorized to leave the goods either with a neighbour or in front of the Customer’s door.

Once the goods are delivered to the designated address or neighbour, responsibility for the goods passes to the Customer. MALWA GROUP is not liable for any loss, theft, or damage occurring after delivery.

If the Customer requests a new delivery date after the order has been placed, or if the Customer contacts the driver to reschedule the delivery due to absence at the original delivery time, additional charges may apply.

4. Product Availability

Products listed on the webshop may occasionally be out of stock, even if they remain available for order.

In such cases, MALWA GROUP will either:

Refund the payment for the unavailable product(s), or

Deliver a similar alternative product of equal or greater value, subject to Customer agreement.

5. Returns and Refunds

Goods may only be returned if they are damaged before being received by the Customer.

In such cases, the Customer will be entitled to a full refund of the damaged goods.

No returns or refunds are possible once the Customer has accepted the goods or once the goods have been left at the designated delivery location.

6. Order Cancellations

After an order has been placed, it cannot be cancelled by the Customer.

MALWA GROUP is under no obligation to refund payments for cancelled or uncollected orders.

7. Governing Law

These Terms and Conditions are governed by Belgian law. Any disputes arising shall fall under the exclusive jurisdiction of the courts in Belgium.
